In March 1980, India's forests were vanishing at the rate of 1.5 lakh hectares a year — an area the size of Delhi disappearing every four months. States were diverting forest land to mining, dams, plantations, and townships with little federal oversight. Between 1951 and 1980, 4.3 million hectares of forest had been converted to non-forest use — more than the area of Kerala.
Indira Gandhi's government responded with the Forest Conservation Act (FCA), 1980 — a short, sharp statute of just five sections that effectively froze state authority. From that day, no state could dereserve a reserved forest or divert forest land to non-forest use without prior approval of the Central Government. Forests stopped being a state subject and became, in practice, a federal one.
For 43 years, that single sentence — Section 2 — was the bulwark of forest governance. Then, in August 2023, Parliament passed the Forest (Conservation) Amendment Act, 2023, renamed the statute Van (Sanrakshan Evam Samvardhan) Adhiniyam, 1980, and carved out eleven categories of exemption from prior approval — including forest land within 100 km of international borders. Environmentalists called it the most consequential forest-policy change in a generation. The Supreme Court is hearing the challenge as you read this.
Why this matters for UPSC

Mains has tested the 2023 amendment in GS-III (sustainable development) and GS-II (federalism). Interview boards routinely probe the tribal rights vs conservation trade-off — the most contested public policy debate in Indian environmental governance today.
